1. Acceptance of Terms

By accessing or using PuzzleMaker Pro ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service. We may update these terms from time to time, and your continued use of the Service after changes are posted constitutes acceptance of the revised terms.

2. Description of Service

PuzzleMaker Pro is a web-based platform that allows users to create, customize, and export educational puzzles including word searches, crossword puzzles, bingo cards, word scrambles, matching worksheets, symbol ciphers, and mazes. Some features use artificial intelligence ("AI") to draft puzzle content from your instructions or allow you to use PuzzleMaker Pro through a compatible third-party AI assistant. The Service is available through free and paid subscription plans.

3. Account Registration

To access certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. User Content

As between you and PuzzleMaker Pro, you own the content you submit to the Service, including prompts, puzzle configurations, and word lists, and the puzzles and educational materials you create using the Service. PuzzleMaker Pro does not claim ownership of those materials.

You may use, copy, edit, publish, distribute, license, and sell the puzzles and educational materials you create for any personal, educational, or commercial purpose. This includes using them in books, worksheets, digital downloads, courses, and other products sold through Amazon or any other marketplace or channel. You do not need additional permission from PuzzleMaker Pro, and you do not owe PuzzleMaker Pro royalties or revenue from those uses. These rights apply to materials created on free and paid plans and continue after your subscription or account ends.

You are responsible for ensuring that the content you submit and the materials you create do not infringe another person's rights or violate applicable law. Your ownership does not include PuzzleMaker Pro's software, branding, templates, or other elements of the Service, except as incorporated into an exported puzzle or educational material created through the Service. Because AI output may be similar to content generated for others, we cannot guarantee that AI-generated content is unique or eligible for intellectual-property protection.

By using the Service, you grant PuzzleMaker Pro a limited, non-exclusive license to host, process, transmit, and display your content only as needed to operate, secure, maintain, and improve the Service. This license does not give PuzzleMaker Pro ownership of your content or the right to sell your puzzles or educational materials.

5. AI Features and Connected Assistants

AI-generated words, clues, answers, and other content may be incomplete, inaccurate, inappropriate, or misleading. You are responsible for reviewing and editing all generated content before printing, assigning, or sharing it, and for deciding whether it is suitable for your students and intended use. Do not rely on AI output as professional, medical, legal, or other expert advice.

When you use built-in AI creation, your instructions and selected activity settings are sent to a third-party AI provider to produce a draft. When you connect a compatible AI assistant, that assistant may send content to and take the actions you authorize within PuzzleMaker Pro. Your use of the assistant is also governed by the assistant provider's terms and privacy policy. You must not submit student personal information, confidential information, credentials, or content you do not have the right to use. We may apply automated safety checks, usage limits, or refusals to AI requests.

6. Acceptable Use

You agree not to use the Service to:

• Create content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
• Infringe upon the intellectual property rights of others
• Attempt to gain unauthorized access to the Service or its systems
• Use automated tools to scrape, crawl, or otherwise extract data from the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Resell or redistribute the Service without our written permission
• Use AI features to generate harmful, illegal, deceptive, or age-inappropriate content, or to evade the Service's safety controls

7. Subscription Plans and Payment

PuzzleMaker Pro offers both free and paid subscription plans. Paid plans are billed on a recurring basis according to the billing cycle you select. You authorize us to charge the payment method on file for all applicable fees. Prices are subject to change with reasonable notice. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

8. Cancellation

You may cancel your paid subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. After that, your account will revert to the free plan. We reserve the right to suspend or terminate accounts that violate these terms.

9. Intellectual Property

The Service, including its design, functionality, logos, and documentation, is the property of PuzzleMaker Pro and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

10. Disclaimer of Warranties

The Service and all AI-generated content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that generated content will be accurate, unique, or appropriate for a particular audience.

11. Limitation of Liability

To the maximum extent permitted by law, PuzzleMaker Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
